Sharia Law in Greece

Abstract

Greece, officially the Hellenic Republic is a particular case pertaining the state – religion relationship. Although the Constitution of Greece explicitly recognizes as the official religion of the state the Eastern Orthodox Church of Christ, at the same time, Greece is the only country in Europe that recognizes the law of Sharia for its Muslim citizens. This is explained due to its international obligations deriving from the Treaty of Lausanne 1923 which was signed the Ottoman Empire and the Allied French Republic, British Empire, Kingdom of Italy, Empire of Japan, Kingdom of Greece, and the Kingdom of Romania. Quite recently, the Greek Government amended the legal framework making the application of Sharia law voluntary on the agreement of the parties.  The aim of this presentation is to explain the status and the scope of Sharia Law within the Greek legal order.
