This study provides a comprehensive overview about the legal defense right in the Saudi regime and EGYPTIAN LAW. It is a right acquired by the force of law that derives its basis from the natural human instincts to protect oneself, honor and money, which requires him to say that an action that may constitute a full-fledged crime in ordinary cases is considered a legitimate act if there are the conditions of legal defense right. It results in the absence of liability, both criminal and civil.
For Difficulty in verifying the availability of legal defense status, the researcher will present in this study a full explanation of the conditions that must be required in order to say that this is a state of legitimate defense, as per the acknowledgment of the Islamic law and statutory laws approved many conditions that the researcher will address with the comparative approach by introducing the right of legitimate defense, its origins, and the conditions to be fulfilled, as well as the definition of Discretion, its basis, and its characteristics between the Saudi regime and comparative Egyptian law.
Question arises as the scope of applying the granted discretion to the criminal judge in assessing the state of legal defense, and the researcher concludes that the criminal judge in the Saudi system has a broad discretion (discretionary) in estimating the surrounding conditions in the act of aggression and defense, unlike the Egyptian criminal judge, whose power largely restricted and does not exceed the implementation of the Egyptian legislator’s will. |
