Abstract : According to transformation the government to a knowledge economy, and for the scientific of innovation and its more value increases as a concept deeply related to intellectual property rights (IP). For this reason, this study came to catch the legal value of innovation in all fields of IP, to identifying the cross-cutting characteristics of these rights to facilitate the understanding of developments IP in the future. This study was an analytical study, to clarify the necessary conditions for legal protection, in addition to analyzing the legal value of innovation among the objective conditions for protection. This study has been divided into two main chapters are devoted to the study of innovation in copyright, then commercial and industrial in IP. The study had done many results, the most important result is the legal value of innovation in IP is not the same. Innovation is the only condition for protection the copyright, while it is one of main conditions in patent protection, and it is expressed in plant varieties and graphic designs with the conditions of distinction and novelty that lead to innovation, as it is expressed in industrial models on the condition of novelty. Novelty demands distinction in the form of the industrial model. As for commercial property rights, innovation does not have a direct role in being entitled to legal protection. Rather, the goal of protecting these rights is to promote innovation and advance its outputs. For all the foregoing, innovation can be relied upon as a distinctive regulator of IP in imposing reliance on broad thinking in the introduction of innovation. When it is a condition of entitlement to legal protection also when it is the purpose of these regulations.
