Abstract : The study addresses criminal liability of clandestine trade of Saudi law. The subject matter of the study is focused on explaining provisions of commercial clandestine trade because it is a very dangerous, aggravated and varied case. It also has a bad effect on development of the country along with the national economy. The study is divided into four chapters. The introductory chapter handles the historical development combat clandestine trade. Then the first chapter explains the meaning of clandestine trade and its aspects. In the second chapter we can learn about prescribed penalties for people who commit this crime according to Saudi law and some of Arab legislations. Finally, the third chapter indicates some judicial applications for the crime of clandestine trade The study aims mainly to examine provisions of clandestine trade in Kingdom of Saudi Arabia and some of comparative countries. We can see that the study depended on analytical comparative method. It concluded multiple results; the most important of them is that clandestine trade crime is one of the most effective crimes for the national economy. It is considered as one of the crimes of arresting obligation. The Saudi legislator has not limited the forms of clandestine trade; but he provided main criteria of which the committed act can be considered as a crime. The study recommended the legislator to translate the legislation with its crimes and sanctions into many languages in order to inform the expatriate workers in kingdom. Moreover, the legislation needs to be amended to define some concepts related to clandestine trade with more details. It is also necessary to intensify the inspection campaigns by the concerned authorities in order to combat this crime.
