This study dealt with the Alternative Sanctions for Custodial Sentences under the Saudi Legal System, by represent what the custodial sentences are, their history, and the short-term custodial sentences, and their negative effects. Also, it presented and analyzed what the alternative sanctions are, and their effects, and legitimacy in Islamic jurisprudence and other laws. Furthermore, it compared the types of alternative sanctions in international conventions, comparative laws, and the Saudi legal system. Along with, it presented the applications of alternative sanctions in international conventions, comparative laws, and the Saudi legal system. with the aim to identifying alternative sanctions as one of the branches of criminal justice and to determine the extent to which they are used to develop the Saudi punishment system. This study is divided into three chapters and introductory, the introductory chapter dealt with the custodial sentences, and its history. Followed by the first chapter which about the short-term custodial sentences, and their negative effects. The second chapter with a statement of the alternative sanctions, the effects biased on them, and legitimacy in Islamic jurisprudence, and other laws. Then at the third chapter, it compared the types of alternative sanctions in international conventions, the comparative laws, and the Saudi legal system and its applications. Finally, the study concluded with the main findings and recommendations. |
