Abstract : The Off-Plan Sale is a special kind of sales, which is very similar to Something calls (Istesnaa) in Islamic jurisprudence, has increased dealings in the last two decades, which led to comparative civil legislation to find legal regulation of this type of sales as in the UAE legislation and the regulator of Saudi Arabia, which issued the first regulations related to this kind of sales. Accordingly, there are two main ideas that will be covered in this research: the first idea is: knowing the subject of Off-plan sales, by knowing the concept of jurisprudence and legal, and knowing his legal conditions, and his legal adjustment, and the difference between him and similar contracts.The second idea is to know the legal effects of this kind of sales, and to know the obligations of the real estate developer and focus of the process of real estate development, including the off-plan sale process, and we have concluded at the end of the study that this sale has the property of other similar contracts.
