This thesis examines the issue of defining images of the author’s moral right, which is the right to publish, the right to attribute the work to it, the right to amend and withdraw, and finally the right to respect the work and its methods of use among partners in multi-authored works, which are called Joint Authorship, in which a number of participants contribute to the authorization of the literature The field of study in this thesis had been defined as discussing and reviewing the Saudi copyright Law and compare it with copyright laws in some countries who follow Latin Laws such as Egypt, France and others also countries who follow Anglo-Saxon Laws such as USA, UK, Canada and other. The study dealt with the conditions of Joint Authorship, which are participation in innovation and participation in achieving the work , we also learned about its types, the first type is Joint Authorship, which cannot distinguish the contributions of their authors and the second is Joint Authorship which can distinguish the contributions of their authors, then we distinguished the Joint Authorship from their closest works, which are Collective works and Derived Work then We reviewed the powers conferred by the moral right of the author and the ways of using them among the partners, and finally we learned about the ways to protect the moral right, whether civil or criminal. several results had been concluded,the most important of which is the Saudi copyright law includse the two types of Joint Authorship , and with regard to the use of the moral right in Joint Authorship, it is clear to us that there is a requirement for consensus when using this rights except in the defense of the work , and it is worth noting that Saudi copyright law did not specify the fate of the Joint Authorship in case the death of one of the co-authors, and with regard to the protection of the moral right, we found a weakness and imbalance between assault and compensation, a fine or even a criminal penalty. |
