This study dealt with the subject of the civil responsibility of the anesthesiologist. This will be done by comparing Saudi law with several Arab laws, which are; Egyptian law in the first place, Emirati law, Jordanian law, and French law that is pioneered and preceded various legal aspects, especially medical responsibility. This study came to clarify that the tasks of a professional anesthesiologist are subject to standard medical principles. It is surrounded by legal problems and practical difficulties, especially as a result of the diversity, multiplicity and seriousness of using types and methods of anesthesia, through treatment or surgical operations. Consequently, because of the lack of jurisprudence in this specialized medical field , and the large number of errors and medical excesses during medical anesthesia practices; and the consequent effects, damages and serious medical complications, especially in intensive care units, recovery centers and medical and surgical emergencies. This requires defining the civil medical responsibility for the anesthesiologist, and the obligations of this legal responsibility, in Saudi medical systems and comparative laws; by knowing what the definition of anesthesia, the tasks of the anesthesiologist, the stages of the anesthesia process, as well as the nature and provisions of civil liability and the legal system for this responsibility arising from the issued error From the anesthesiologist, the methods for proving and denying it, and the extent of the anesthesiologist’s commitment, which is excluded from the general rule of the physician’s commitment to exercise care, so his commitment to achieve a result is represented in his work and tasks as a medical specialist. |
