Abstract : This study discusses the compulsory license by exploiting the patented invention, according to the Saudi National Patent Law and Regulations, the provisions of the Paris Convention, and TRIPS Agreement. The study's approach is the analytical one. It is divided into three fields of discussions focus on the compulsory license by explanation of its concept; defining it beside its legal nature. Also, it defines the cases of granting the compulsory license stated by the Saudi National Patent Law and Regulations and the required conditions to grant this license. In addition, it discusses the implications and the compulsory license and its causes of terminations. As well as it reflects what extent the provisions of the compulsory licensing stated by the Saudi National Patent Law and Regulations are consistent with the kingdom obligations emanating from Paris Convention and TRIPS Agreement. The research ends up with that the Saudi National Patent Law and Regulations in respect of the compulsory licensing are indeed consistent with the kingdom obligations arising from TRIPS Agreement. Sometimes, it provides over protection which exceed the level defined the agreement. This study recommended the amendments of some laws' regulations, especially the ones who provide better and greater protection to the inventions more than the protection provided by TRIPS Agreement.
