Abstract : The title was particularly chosen because of the scarce circumstances so dictate, especially in our geographic dimension and it also applies to the lack of coverage of its regulatory mechanism or simply have its impact reviewed on the path to development and the documentation of the inclusiveness of its ex-contractu of the investments shift to achieve one of the ends sought of the Saudi Vision 2030. We started the study with a presentation of the evolution of the country’s function to the first appearance of the need to actually engage in and have contracts with diver parties in order to achieve its desired Development Goals that meet the needs of all members of society as well as it have also had identified the problems that could be faced in the search of the role of the B.O.T contracts in achieving such goals without prejudice to the country’s ability of fulfilling the needs of the future generations in which it promises a better return to both the country and its individuals by shedding light on the obstacles and challenges that it might be hampered by. Therefore, the study has been divided into three chapters, Chapter I tackles Sustainable Development according to the Saudi Vision 2030, its dimensions and objectives and all the requirements and obstacles and its strength factors that are essential to the long-term sustainability of development. Then we had the B.O.T contracts and covered in the Chapter II, we addressed its role in the attainment of Sustainable Development and how it differs from any other type of contract, its barriers, its types etc... Finally in Chapter III, we did present some implementations of B.O.T contracts in Saudi Arabia and other MENA countries. The study indicated that the implementation of these contracts in the countries mentioned bring them to the forefront as countries that have had its present and future secured. It has as well indicated the demand to codify the provisions of the Islamic Law, thus the poor legislative infrastructure is found one of the major obstacles that stands in the way. Hence it recommends the Saudi Legislator to act upon activating and codifying the provisions of the Islamic Law, Sharia and replenish the organizational legal structure as it is seen a basic necessity of our time also to speed up the promulgation process of a system that regulates the B.O.T contracts and develop a legislative infrastructure for this type of contract in which it will ensure an actual activation of it in the desired goals.
