This letter deals mainly with the protection of the vulnerable party in the contract, which is a matter of legal importance, given the widespread dealings in typical model contracts with economically strong parties of a professional nature, given the weight of the ordinary weak party overburdened by unequal obligations. This study dealt with the most important rules and general principles that must be respected in the contracts and commitment to work in all cases. The solution of the contract, in addition to addressing the most important rules of the Saudi regime in the contracts, in terms of injustice, exploitation, coercion and fraud, various types of contracts and other problems, and also reviewed the special protections put in place for the weak party, specifically in a particular type of contracts, such as labor and insurance contracts The study dealt with cases of judicial intervention to correct or invalidate contracts, in order to achieve the protection of the weak party, through which it can raise the level of protection of the weak party in the contractual relationship, and then reduce the arbitrariness in the typical contracts The standard model, Ross reached A number of conclusions and recommendations, the most important of which is to give the powers of consumer protection associations to represent the weak party before the judiciary. |
