Study Issue: The main issue of this study is, the double responsibility of the public officer, regarding an offence that commands both, disciplinary and penal responsibility. In that case we are facing two different adjudication, rendered from two different entities, one is administrative and the other is penal. However the objective of this study is to reveal the misunderstanding, by realizing the binding force of the penal adjudication.
Study Objective: This study addresses many issues, especially clearing the binding force of the penal adjudication, and specifying the impact of the penal adjudication, whether by convection or discharge, on the administrative claim investigations, and demonstrating the relation between the penal adjudication and the related job.
Study Approach: This study adopts the Analytical Descriptive Approach, in addition to Comparative Approach.
Study Results: The binding force of the penal adjudication, is based on meeting some conditions, among the most important of the same, if the adjudication is final and binding, which renders the preliminary adjudication not immune due to the binding force of the adjudication, while the discharge adjudication, shall not keep the administrative entity from continuing the investigations, further it shall not necessarily keep the administrative entity from the disciplinary punishment.
Recommendations: Defense rights guarantees, before the Disciplinary Court, must be similar to those, granted before Penal court, and limiting the binding force of the penal adjudication, to the liabilities related only to the Public Possession, and violating the Public Service Regulations, otherwise it must have no impact. |
