Administrative Liability Without Fault Under Saudi Law -Analytical study- Done by: Maram Yahia Ali Hargani Instructed by : Dr. Sabah Al-Masri Abstract This study dealt with administrative liability without fault in the Kingdom of Saudi Arabia through studying administrative liability without fault as a theory; its emergence, development and verdicts. Then it studied administrative liability without fault in the Saudi system to recognize the perspectives of the Saudi legislator and the Board of Grievances of the administrative liability without fault. This study has been divided into an introductory chapter and two main chapters: in the introductory chapter, the administrative liability in general and its development, then, the essence and properties of administrative liability without fault. In the first field, legal fundamentals of administrative liability without fault and its components, were discussed. The final field is about the impact of administrative liability without fault and the attitude of Saudi system of it, between evaluation and modification. The most significant results and recommendations found by the researcher are displayed in this study. The most prominent aspect was the distinction of the Saudi legislator in its legislative stance of administrative liability without fault where its attempts of applying this type of liability according to the concept of insurance instead of responsibility; consequently, transferring the compensation of the harmed in special cases of philanthropy into obligations, where the state makes itself committed to compensate in accordance to a legal text without the need to claim responsibility. As for the results, the most important was that the stance of the Board of Grievances in the Kingdom of Saudi Arabia as it became obvious and firm when it comes to administrative liability without fault, its judgments has agreed, until this day, to administrative liability without fault The researchers most importan |
