Abstract : The significance of this study lies in highlighting the gravitas of leaking confidential documents and information that are subject to the liability protection and the importance of preserving them, as well as the seriousness of the violations of publishing and disclosing such confidential documents and information. In addition, the study aims to formulate a legislative framework to combat these crimes, and also to illustrate the penalties prescribed to such violations. The main focus of this study also lies in clarifying what constitutes a confidential document or information as well as identifying the actions that are considered a violation of their secrecy. The study will further highlight the consequent damage due to this breach of confidentiality which may threatens the security, stability and sovereignty of the state. As such, this research study aims to answer the following questions: What is the nature of the criminal liability for publishing confidential documents and information? Who are the individuals concerned with the legislative penalty penal system for the publication and disclosure of confidential documents and information? What are the general sections of this criminal liability for publishing and disclosing confidential documents and information? What are the penalties that have been passed for such crimes? What are the mitigating and aggravating circumstances of such penalties? The methodology that is utilised in this is the comparative content analysis descriptive approach. The study included an introduction, a background chapter, three subsequent chapters, and a conclusion. These chapters of the study dealt with first, what constitute a confidential document and information, then, the criminal liabilities for publishing and disclosing confidential documents and information, and the penalties prescribed for these violations. The study has also several drawn conclusions, the most significant of which is that Islamic Sharia has given great prominence to confidential documents and information and obligated keeping their secrecy and integrity. Furthermore, the Islamic Sharia has prohibited their publication or disclosure and mandated criminal liability and deterrent penalties for anyone who violates or transgresses upon their secrecy and integrity. As such, the Saudi and Egyptian legislative systems have both implemented the aforementioned elements of the Islamic Sharia in that regard. Upon the most important recommendations in this study is that the various sectors and institutions of the society should make a priority the perseverance of the sanctity of all the laws that pertains to the protection of confidential documents and information, as well as raising the level of security alertness and raising awareness among government and state employees of the importance of preserving confidential documents and information, paying great care to the confidentiality and utmost caution when dealing with them.
